1. Scope
Membership entitles the member to use the entire training area and the relax lounges during official business hours.
2. Membership
2.1 Membership is personal, it is not transferable and will not be automatically extended.
2.2 KINERO offers different memberships and services. Services offered are based on the paid membership. All other services offered at KINERO are not included in our membership fees.
2.3 Membership entitles the member to use KINERO facilities outside the supervised business hours. Therefore, by signing the agreement, the member acknowledges that he/she is aware of the risks and that the use of all equipment and rooms is at his/her own risk and discretion.
2.4 To become a member, the applicant must be at least 25 years old.
2.5 Members must inform KINERO of any changes in address.
2.6 A membership upgrade is possible anytime for a processing fee of CHF 50.00.
2.7 The KINERO house rules are an inherent element of the general terms and conditions of business and must be followed at all times. The house rules are posted in every locker.
3. Operating times & business closing
3.1 KINERO is open to members during the following hours, except for national holidays, overhauls, renovations, upgrades (approx. 2 weeks/year), from Monday to Friday, from 7:00 a.m. to 10:00 p.m. And on Saturday and Sunday from 9:00 a.m. To 8:00 p.m. Operating hours may be adjusted. Changes or special opening times will be posted around the facility well in advance.
3.2 No claims can be made for refunds or membership fee adjustments due to necessary operational closures, changes in services or operations and/or if the business shuts down.
4. Use & Time-Stop (deposit)
4.1 Non-use of the KINERO facilities does not entitle the member to fee reductions or a refund of the membership fee.
4.2. Members with a one or two-year membership are entitled to a time-stop (contract interruption) under the following circumstances and by leaving behind their chip card: illness, accident, pregnancy, overseas military service if these are verified by a medical certificate or other relevant proof. For each contract interruption, a processing fee of CHF 50.00 will be charged.
4.3 If the member relocates, he/she is entitled to a partial refund of the effectively paid membership fee* up to 6 months after the contract becomes valid, afterwards, the membership is considered written off.
- In the 1st month: Refund = 50 % of the contract price*
- In the 2nd month: Refund = 40 %
- In the 3rd month: Refund = 30 %
- In the 4th month: Refund = 25 %
- In the 5th month: Refund = 15 %
- In the 6th month: Refund = 10 %
5. Video monitoring
To protect its members, the KINERO facility is monitored using video cameras. The recordings are saved for as long as is necessary to safeguard its members in case of individual incidents and to clarify any criminal activity. Notices posted around the facility will identify the video monitoring cameras and the responsible office. The relevant provisions of the Data Protection Act shall be complied with. Should one of the provisions be or become invalid, this shall not affect the other provisions. In this case, the legal provisions shall apply.
6. RFID card, access rights & reservations
6.1 The RFID card provided is non-transferable and shall be used to authorize members entry to the facility.
6.2 Members use the RFID card in the reception area to independently check in and check out.
6.3 The RFID card is provided in exchange for a deposit fee of CHF 20.00. For memberships, the deposit is included in the membership fee. The deposit will be refunded in cash when the RFID card is returned.
6.4 Entry and exit times as well as the use of services not included in the membership are recorded by means of the RFID card. The relevant reservations are binding! Payment shall be made by credit card, EC Maestro debit card, cash or an invoice.
6.5 Loss or theft of an RFID card, or a defective RFID card, must be immediately reported so that it can be canceled. If the RFID card has to be replaced, a deposit fee will be charged again.
6.6 Bringing guests (also children) and animals is not permitted. If the right of access is abused (loaning card to non-members, letting in two or more people or similar), consequences include, without advanced warning, immediately blocking the RFID card, canceling membership and the lodging of a complaint. The member shall not be entitled to a refund of the paid membership fee.
6.7 Cabins can be reserved online, but if the member does not show up, he/she will be charged a fee of CHF 10.00.
7. Payment & Credit
7.1 The membership fee must be paid when the agreement is signed or when the membership is renewed. The fee can be paid for by credit card/EC Maestro debit card, cash or invoice. If per invoice, then the fee must have been deposited before the contract begins.
7.2 Any possible credits are forfeited if not claimed prior to the expiry of the contract and cannot be paid out.
8. Liability
8.1 The use of the KINERO facility and its equipment shall be at the member’s own risk. KINERO or its personnel shall not be held liable for damages as a result of an accident, injury or illness. Obtaining an insurance policy is the member's responsibility.
8.2 KINERO shall not be held liable for the loss or damage (also in the lockers) of valuables, money, clothing, RFID cards, etc. Obtaining an insurance policy is the member's responsibility.
8.3 If it is impossible for KINERO to provide certain services as a result of uncontrollable circumstances (force majeure), the member shall not be entitled to compensation.
9. Changes to the general terms and conditions of business and operational regulations
The member shall acknowledge that KINERO reserves the right to make changes to the general terms and conditions of business and the operating regulations and that the member shall be informed of said changes in a suitable format. The member is not entitled to derive rights from changes in the general terms and conditions of business or operating regulations.
10. Applicable law and court of jurisdiction
All legal relationships from the present contract are subject to Swiss law. The court of jurisdiction is Wilen b. Wollerau / Freienbach.
